Do not believe everything you read on the internet!

Not just good advice from your mother but also good advice when confronted with the loss of a loved one. Probate is not a do-it-yourself place!  What happens when someone dies, assuming that they have not been successful in planning their estate, is known as the Probate Process.  contrary to much of what you read on the internet it is not a simple on two three process.  Sometimes that process requires filing with the local probate court – sometimes it does not.  

Sometimes that probate process can take years sometimes it can take months sometimes it doesn’t need to be done.  Every state is different.  Different property is probated differently.  Sometimes it’s very complicated.  Sometimes it is very simple.  There are times when it can be very expensive and there are times when it is not very expensive.  

What can be said about probate – and  that it applies to every probate – is that every trip to probate is a different process. Your uncle’s estate is different than your cousin’s estate; different than your grandmother’s estate: different than your brother-in-law’s estate: different than the estate of your friend down the street: and is sure is different than it was 20 years ago when Aunt Sally died.

The Missouri probate code can be undaunting for those who have not been involved in probate before.  It can seem to be virtually unreadable and incomprehensible.  sometimes when you think you figured it out you can be 180 degrees off. To paraphrase the old saying “Probate isn’t for Sissies!”
